By creating an account or using HireGate, you agree to these Terms.
1. About HireGate
HireGate provides technology designed to facilitate cooperation between candidates, employers, recruitment agencies, recruitment partners and their authorized representatives. Depending on available functionality, HireGate may provide candidate profiles, job vacancies, recommendations, recruitment pipelines, interview scheduling, messaging and notifications, company/partner collaboration, document management and third-party integrations.
HireGate is a technology platform. Unless a separate written agreement says otherwise, it is not the employer, employee, immigration authority, government authority or a party to an employment relationship created between users.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. If using HireGate for an organization, you confirm that you are authorized to bind or represent it.
3. Accounts
Users must provide accurate and current information and are responsible for account security, credentials, activity through the account, appropriate individual accounts for authorized staff, and prompt notice of suspected unauthorized access. You may not transfer, sell or share an account in a way that compromises security or accountability.
4. User roles
Candidates
Candidates may create professional profiles, provide CV and employment information, apply for positions, participate in recruitment processes, communicate with employers or recruiters, schedule interviews and provide recruitment-related documents.
Companies
Companies may create company profiles, create and manage jobs, review candidates, participate in recruitment, appoint authorized representatives and work with contracted recruitment partners.
Recruitment partners
Recruitment partners may manage authorized recruitment processes, review authorized candidates, communicate with candidates, coordinate interviews and collaborate with employers. Access depends on Platform configuration and contractual relationships.
5. Recruitment-partner authorization
Partners may access or manage recruitment activity only where an appropriate authorization or valid relationship exists. They must not falsely claim to represent an employer. Companies must keep recruitment relationships accurate. HireGate may restrict access if a relationship expires, is terminated, disputed or cannot reasonably be verified.
6. Candidate information
Candidates are responsible for information being substantially accurate and not deliberately misleading. They must not impersonate others, falsify qualifications or identity documents, intentionally give false employment history, or manipulate recruitment processes. Employers and recruiters remain responsible for suitable verification before decisions.
7. Employer and recruiter responsibilities
Employers and recruitment partners must use candidate data only for lawful recruitment and related purposes; respect privacy and employment laws; provide accurate job information; avoid misleading advertisements, unlawful or unnecessary data requests and unlawful discrimination; maintain authority to recruit; protect data; and accurately represent salary, conditions and material employment terms. HireGate may remove or restrict listings or accounts posing meaningful legal, security or fraud risk.
8. Job advertisements
Organizations publishing vacancies are responsible for their content and legality. Advertisements must not contain intentionally false information, misrepresent the hiring organization, advertise unlawful employment, require illegal candidate payments, facilitate trafficking, exploitation or forced labor, discriminate unlawfully, infringe rights, or contain malicious links or software. HireGate may review, restrict or remove violating content.
9. Employment, visa and migration disclaimer
HireGate facilitates recruitment but does not guarantee employment, selection, hiring, salary, conditions, a visa, work or residence permit, immigration approval, recognition of qualifications, government-issued documents, or completion of a recruitment or migration procedure by a particular time. Employers and competent authorities make employment, immigration and visa decisions. Platform information is not legal, immigration, tax or employment-law advice unless expressly provided by a qualified professional under a separate engagement.
10. No employment relationship with HireGate
Using HireGate does not itself create an employment relationship with HireGate, agency relationship, partnership, joint venture or fiduciary relationship. Employment is established separately between the relevant candidate and employer.
11. Third-party organizations
Companies, recruitment partners and candidates are separate Platform users. HireGate does not control every act or statement by users. Users should conduct appropriate due diligence before entering employment, recruitment or commercial relationships.
12. Google integrations
Where enabled, users may connect Google for account connection, authentication, identifying the connected account, calendar availability and interview-event creation, updates or cancellation. Google functionality is governed by Google's terms, policies and permissions; users may revoke authorization through Google. Processing of Google user data is described in the Privacy Policy.
13. User content
"User Content" includes information, text, images, documents, CVs, job descriptions, messages and other material submitted through HireGate. You retain ownership where applicable. You grant HireGate a limited, non-exclusive right to host, process, reproduce and display it only as reasonably needed to operate the Platform, provide requested functionality, facilitate relevant recruitment, maintain security and comply with legal obligations. You confirm you have all rights and lawful authority required to submit it.
14. Personal data belonging to others
Users uploading another person's personal information represent that they have a lawful basis and appropriate authority, including responsibility for required privacy notices or consent. HireGate may delete or restrict information where there is a reasonable concern it was uploaded unlawfully.
15. Intellectual property
HireGate and its licensors retain all intellectual-property rights in Platform software, source code, interfaces, branding, logos, databases, design, documentation and proprietary functionality. Except when expressly permitted, users may not copy software, reverse engineer the Platform, reproduce substantial parts, circumvent restrictions, create unauthorized derivative services, or scrape or systematically extract Platform data.
16. Acceptable use
You may not use HireGate to violate law, commit fraud, impersonate others, distribute malware, gain unauthorized access, scrape candidate data, harvest contacts, spam, discriminate unlawfully, exploit workers or candidates, facilitate trafficking or forced labor, threaten or abuse others, infringe IP, circumvent controls, build unauthorized candidate databases, or sell personal information obtained through HireGate. Automated access is prohibited unless expressly authorized through an official API or written agreement.
17. Prohibited candidate fees and exploitation
Users must comply with recruitment and employment law concerning candidate fees. HireGate must not facilitate illegal charges, confiscation or unlawful retention of identity documents, forced labor, coercive recruitment, deceptive employment schemes, trafficking or unlawful wage withholding. HireGate may suspend or terminate accounts where reasonably suspected and cooperate with authorities where law requires.
18. Platform communications
Users may receive account, recruitment, interview, security and service communications necessary for the Platform and which cannot always be disabled while the account remains active. Marketing communications are handled under applicable law and the Privacy Policy.
19. Third-party services
HireGate may integrate with third-party services. We are not responsible for their independent processing, changes, functionality or outages. Use may be subject to their terms.
20. Platform availability and changes
We aim for a reliable Platform but do not guarantee uninterrupted availability. HireGate may modify, add or discontinue functionality, maintain the service, impose reasonable technical limitations and change integrations. Significant paid-customer changes may be communicated where commercially reasonable and according to applicable agreements.
21. Suspension and termination
HireGate may suspend or restrict an account for Terms violations, fraud, security risk, unauthorized access, unlawful personal-data processing, deceptive recruitment, non-payment, legal requirements or material risk to users or HireGate. Where appropriate, users may have an opportunity to remedy a violation; access may be restricted immediately to prevent significant harm, fraud or security risk.
22. User termination
Users may stop using HireGate and request account deletion through Platform functionality or the Privacy Policy. Termination does not remove pre-existing obligations or liabilities. Information may be retained for law or legitimate business needs.
23. Paid services
For paid services, prices, billing periods and commercial terms may appear at checkout, in an order form, subscription agreement or separate commercial contract. Expressly agreed commercial terms prevail over these Terms for the purchased service where they conflict.
24. No guarantee of user information
HireGate provides tools for users to provide and review information but does not guarantee candidates, employers, partners, documents, qualifications, advertisements or statements have been independently verified, unless we expressly state a particular verification service was performed. Appropriate recruiting or employing organizations remain responsible for verification.
25. Disclaimer of warranties
To the maximum extent permitted by law, HireGate is provided on an "as available" basis. We do not warrant uninterrupted or error-free service, candidate suitability, continuing job availability, successful recruitment, user compliance, or successful immigration or government procedures. Nothing excludes rights that cannot lawfully be excluded.
26. Limitation of liability
To the maximum extent permitted by law, HireGate is not liable for indirect or consequential losses arising from employment decisions; candidate, employer or recruiter actions; government decisions; visa or immigration outcomes; user-provided information; third-party services; or circumstances outside our reasonable control. Separately signed commercial limitations remain applicable. Nothing excludes liability that cannot lawfully be excluded or limited.
27. Indemnification by business users
To the extent permitted by law, business users are responsible for claims arising from unlawful advertisements, unlawful candidate-data use, IP infringement, recruitment/employment-law violations or material Terms violations. This does not apply to HireGate's own unlawful conduct.
28. Privacy
Personal-data use is governed by the Privacy Policy. Users independently processing data through HireGate remain responsible for their compliance obligations.
29. Changes to these Terms
We may update these Terms for legal, Platform, functionality, security or business changes. Material changes may be communicated to registered users where appropriate. Continued use after effectiveness is acceptance where permitted; where law requires separate consent, we will request it.
30. Governing law
These Terms are governed by the laws of the Republic of Bulgaria, subject to mandatory consumer protections that may apply elsewhere.
31. Disputes and jurisdiction
Users should first contact HireGate so disputes can, where possible, be resolved amicably. Subject to mandatory law, disputes are submitted to the competent courts of the Republic of Bulgaria.
32. Severability
If a provision is invalid or unenforceable, remaining provisions remain effective to the extent permitted by law.
33. Entire agreement
These Terms, the Privacy Policy, Cookie Policy and any applicable separate commercial agreement form the agreement governing Platform use.
